Terms of Service

EStall provides online tools that let creators publish storefronts, list products and services, accept orders, and manage fulfilment workflows. We are a technology platform, not the seller of creator goods or services.

Except where we explicitly say otherwise, EStall does not take title to items sold, does not guarantee fulfilment, and is not a party to the contract of sale between a buyer and a creator. Each creator is an independent seller responsible for their listings, pricing, policies, fulfilment, and compliance with applicable law.

Buyer means a person who purchases or attempts to purchase through a creator storefront on EStall.

Creator means a user who operates a storefront or sells through EStall.

Order means a transaction initiated through EStall checkout for items offered by a creator.

Platform fees means the feesEStall charges creators for use of the marketplace, currently 5% on item subtotals as described below.

You must be at least 18 years old and able to enter a binding contract to use EStall. Creators must provide accurate business and payout information and keep account credentials secure.

You are responsible for all activity under your account. Notify us promptly if you suspect unauthorised access. We may suspend or close accounts that are inaccurate, inactive, abusive, fraudulent, or risky for buyers, creators, or the platform.

Creators are solely responsible for their listings, descriptions, images, pricing, stock, digital files, service delivery, taxes, and compliance with South African law, including the Consumer Protection Act where it applies to their sales.

Creators must publish honest buyer policies on their storefront, including dispatch and returns/refunds where relevant, and honour those policies unless a higher legal standard applies. Creators must not list illegal, unsafe, infringing, misleading, or prohibited items or services.

By listing content on EStall, creators confirm they have the rights needed to sell and display that content, and they grant EStall a non-exclusive licence to host, display, and transmit listing materials solely to operate the service.

Creators accept these terms when they create or operate a storefront, not only when a buyer checks out.

When you buy on EStall, your purchase contract is with the creator, not with EStall. Review the creator's storefront policies, item details, shipping method, and price before paying.

Buyers must provide accurate checkout details, cooperate in fulfilment where needed, and raise issues honestly and in good faith through the order tools provided.

An order is created when you submit checkout details on EStall. Payment still needs to complete before the order becomes payable and moves into fulfilment. We may cancel or refuse orders affected by obvious pricing errors, suspected fraud, unavailable inventory, or technical failures.

Prices are shown in South African Rand unless stated otherwise. Shipping, collection, local delivery, or other fulfilment charges may be shown separately at checkout.

By completing checkout, buyers confirm they agree to these terms, the Privacy Policy, and the applicable creator policies shown during checkout.

Payments are processed through third-party payment providers such as Payfast. Card and bank details are collected and processed by those providers, not stored directly by EStall.

An order is only treated as paid after the payment provider confirms successful payment to EStall. We are not responsible for payment provider downtime, declines, reversals, chargebacks, or delays outside our reasonable control.

Chargebacks, payment reversals, and similar disputes may result in order adjustments, withheld creator balances, account review, or recovery from amounts otherwise payable to a creator.

Payment transactions are subject to the terms and conditions of the applicable payment provider. EStall does not control payment provider approval, declines, processing times, reversals, or settlement.

EStall charges 5% on item sales only. Shipping fees you set are passed through to you in full. PayFast processing is covered by EStall and is not deducted from your earnings.

EStall may change platform fees or fee structures with reasonable notice. Continued use of creator tools after the effective date of a fee change constitutes acceptance of the updated fees for new orders.

Creator earnings shown in the dashboard are estimates for operational purposes. Final payable amounts may change because of refunds, chargebacks, adjustments, holds, rejected payouts, or compliance reviews.

Creators are responsible for preparing, shipping, delivering, collecting, or providing access to purchased items. Order status tools on EStallhelp track progress but do not replace the creator's fulfilment duties.

After a creator marks an order as fulfilled, buyers may confirm receipt or report a problem within a review period. Unless an issue is reported, orders may automatically move to completed after approximately 5 days from fulfilment, or earlier if the buyer confirms receipt.

Automatic completion is an administrative workflow feature. It does not mean EStall has inspected goods or services, verified delivery, or adjudicated a dispute in the creator's favour.

Where creators sell digital goods, access may become available after payment depending on how the product is configured. Creators remain responsible for the legality, quality, completeness, and ongoing availability of digital files or links they provide.

Unless a creator grants broader rights in writing, purchase of a digital product gives the buyer a personal, non-transferable licence to use the delivered material for its intended purpose. Buyers may not redistribute, resell, or publicly share paid digital content unless allowed by law or by the creator.

EStall is a marketplace that connects buyers with independent creators. Each creator is responsible for publishing their own refund, return, and cancellation policy on their storefront. These policies must comply with applicable South African law, including the Consumer Protection Act where applicable.

Buyers should review the creator's refund, return, cancellation, and fulfilment policies before completing a purchase. Where a buyer wishes to cancel an order or request a refund, the buyer should submit the request through the order tools provided by EStall or contact the creator using the available order information.

Refund requests will be handled in accordance with the creator's published policy and applicable law. Where a refund is approved, it will normally be returned using the original payment method where technically possible. Processing times may vary depending on the payment provider.

If a buyer and creator cannot resolve an issue directly, EStallmay review the order information and assist with communication between the parties. EStall may take appropriate action where required by law, where there is evidence of fraud or abuse, or where platform rules have been breached.

Nothing in these terms limits any consumer rights or remedies that cannot lawfully be excluded under applicable South African law.

Fraudulent activity, repeated chargebacks, or abuse of the platform may result in account suspension, cancellation of orders, withholding of balances, or termination of an account.

Creator balances may be held until orders complete through buyer confirmation, expiry of the review period, or another release event shown in the product. Withdrawals are subject to manual review, minimum amounts, and payout details supplied by the creator.

Minimum withdrawal requests are currently 100 ZAR or as otherwise shown in the creator funds area. Approved payouts are usually processed within 3–5 business days, but timing depends on banking, verification, and compliance checks.

EStall may delay, reject, reverse, or offset payouts to recover refunds, chargebacks, fees, penalties, suspected fraud, or amounts owed to buyers or the platform.

Buyers may leave reviews after eligible orders complete. Reviews must be honest, relevant, and based on genuine experience. We may remove or restrict reviews that are abusive, misleading, retaliatory, or otherwise harmful.

We may send service, order, and account notifications by email, WhatsApp, or other channels you enable. Message and data rates may apply where relevant.

You may not use EStall to break the law, infringe intellectual property, harass others, distribute malware, manipulate reviews, abuse checkout or payout systems, or create security or reputational risk for the platform.

We may remove content, cancel orders, withhold funds, or suspend access where we reasonably believe a user or listing creates legal, fraud, or safety risk.

EStall offers optional paid Pro features for creators. The price, billing frequency, renewal date, and features included in a Pro plan are displayed before purchase.

Pro subscriptions renew according to the billing period selected at checkout unless cancelled before the next renewal date. Cancellation prevents future renewals but does not necessarily provide a refund for the current billing period, except where required by applicable law.

If a payment for a Pro subscription fails, access to paid features may be restricted until payment is successfully completed.

EStall is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not guarantee uninterrupted service, error-free operation, or that any creator, listing, or transaction will meet your expectations.

We do not warrant the quality, safety, legality, or suitability of any creator goods or services. Any reliance on listings, advice, or policies published by creators is at your own risk.

To the fullest extent permitted by South African law, EStall and its operators, directors, employees, and suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption arising from use of the platform.

To the extent we are liable despite the above, our total aggregate liability for claims relating to the platform in any 12-month period is limited to the greater of (a) the platform fees you paid to EStallin that period, or (b) ZAR 1,000.

Nothing in these terms limits liability that cannot be excluded under applicable law, including certain consumer rights where EStall itself is legally responsible.

Creators and other users agree to indemnify and hold harmless EStallagainst claims, losses, penalties, and reasonable costs arising from their listings, products, services, fulfilment failures, policy breaches, intellectual property infringement, tax issues, or misuse of the platform, except to the extent caused by our own intentional misconduct or gross negligence.

Our Privacy Policy explains how personal information is collected, used, shared, and protected under POPIA. Buyers understand that order fulfilment requires sharing relevant contact and delivery details with the creator they purchase from.

We may update these terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes take effect constitutes acceptance, except where the law requires a different approach.

We may suspend or terminate access immediately where needed to protect users, comply with law, respond to payment risk, or prevent abuse.

These terms are governed by the laws of the Republic of South Africa. Disputes relating to EStall itself should be brought in the South African courts with jurisdiction, unless mandatory law provides otherwise.

Disputes about a specific purchase should first be addressed between the buyer and the creator, using the order information and policies available on the platform.
